The Small Estate Affidavit is a Colorado form that allows an appropriate party to collect and distribute assets of a deceased party to the people entitled to receive them simply through the use of the affidavit WITHOUT seeking court involvement. The most significant criteria for the use of a Small Estate Affidavit is that the total value of the property, less any debts, does not exceed $80,000 (in 2023). This can be used when there is no pending or actual appointment of a personal representative. However, it only relates to personal property and cannot be used to transfer real estate.
